2023 Ute Pass Evacuation Exercise Registration Form

I agree to participate in the above named Ute Pass Neighborhood Evacuation Drill. I know of no physical or mental condition which would keep me from participating in this Exercise. I understand that this Exercise will involve active physical participation, which includes a potential risk of personal injury and personal property damage. I agree to follow the exercise rules and instructions during my participation.

Waiver and Liability: As used in this paragraph, the term “Governmental Entities” means and includes the Colorado State Patrol, El Paso County Sheriff’s Office, Pikes Peak Regional Office of Emergency Management, and their respective officers, appointees, employees, and agents. Participant in consideration for participating in the Exercise, does hereby, on behalf of the Participant and the Participant’s heirs, assigns, successors, or any person claiming or attempting to exert a claim against the Governmental Entities as a result of Participant’s taking part in this Tri-Lakes Ute Pass Neighborhood Evacuation Drill, does hereby expressly waive, remise and release any claim, right, or cause of action whatsoever, including but not limited to any claim of negligence, which the Participant or they may have, acquire, or which may accrue in the future, against the Governmental Entities and the Governmental Entities’ respective officers, appointees, employees, and agents, arising in whole or in part from or as a result of the Participant participating in this Ute Pass Neighborhood Evacuation Drill, including but in no way limited to, physical, mental, economic, or emotional injuries, or death. Participant further agrees to indemnify and hold harmless the Governmental Entities, and their respective officers, appointees, employees, and agents as a result of Participant’s participation in the Exercise. This Participation and Waiver Agreement is subject to and shall be interpreted under the law of the State of Colorado. Court venue and jurisdiction shall exclusively be in El Paso County District Court, Fourth Judicial District of Colorado.

Photographs: Participant hereby gives permission, without restriction, to all Governmental Entities to use name, voice and/or likeness, including but not limited to any and all photographs, videotapes, sound recordings, and/or other media-visual electronic materials taken during the Ute Pass Neighborhood Evacuation Drill or on behalf of El Paso County.
